ADULT PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDICAL AUTHORIZATION AND MEDIA RELEASE

In consideration of being permitted to participate in the event identified above, including any race, walk, run, team event, related activity, practice, warm-up, awards ceremony, or other activity associated with the event, collectively referred to as the “Event,” I acknowledge and agree to the following:

1. VOLUNTARY PARTICIPATION

I understand that my participation in the Event is voluntary. I represent that I am physically capable of participating in the Event and that I am responsible for determining whether I am sufficiently fit and prepared to participate safely.

I understand that I may stop participating at any time if I believe that continuing would be unsafe.

2. ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I understand that participation in running, walking, racing, and related athletic activities involves inherent and other risks that may result in serious bodily injury, illness, disability, property damage, paralysis, or death.

These risks may include, but are not limited to:

• strenuous physical exertion, fatigue, dehydration, overheating, heat-related illness, hypothermia, or other medical conditions;
• heart attack, cardiac events, respiratory problems, or other health emergencies;
• falls, slips, trips, collisions, or contact with other participants, spectators, volunteers, vehicles, bicycles, animals, equipment, or other objects;
• uneven, damaged, wet, slippery, loose, obstructed, or otherwise hazardous surfaces;
• streets, sidewalks, trails, parking areas, curbs, potholes, railroad crossings, intersections, and other course conditions;
• motor vehicle traffic and the actions of drivers or other members of the public;
• weather conditions, including heat, cold, rain, wind, lightning, poor visibility, and rapidly changing conditions;
• inadequate or unavailable water, medical assistance, course markings, traffic control, or other Event services;
• the acts or omissions of other participants, spectators, volunteers, contractors, governmental entities, property owners, or other third parties;
• risks associated with equipment, timing systems, course barriers, signs, tents, stages, and other Event-related equipment or structures; and
• other risks and hazards associated with participation in or attendance at a road race, running event, walking event, athletic competition, or related activity, whether known or unknown, foreseeable or unforeseeable.

I understand that this list is not exhaustive.

I KNOWINGLY AND VOLUNTARILY ACCEPT AND ASSUME THE RISKS ASSOCIATED WITH PARTICIPATING IN THE EVENT, INCLUDING THE RISK OF SERIOUS INJURY OR DEATH.

3. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by California law, I, for myself and for my heirs, estate, personal representatives, executors, administrators, successors, and assigns, hereby release, waive, and discharge the Event organizer and each of the following persons and entities associated with the Event:

• the Event organizer;
• sponsoring and participating organizations;
• officers, directors, employees, members, agents, representatives, and volunteers;
• race directors and officials;
• contractors and service providers;
• sponsors and advertisers;
• property owners and property managers;
• municipalities, public agencies, governmental entities, and other entities permitting the use of roads, facilities, or property for the Event; and
• each of their respective officers, employees, representatives, agents, volunteers, successors, and assigns,

collectively referred to as the “Released Parties.”

I release the Released Parties from claims, demands, damages, actions, or causes of action arising out of or relating to my participation in the Event, including claims for personal injury, illness, death, or property damage caused in whole or in part by the ordinary negligence of a Released Party, to the fullest extent permitted by law.

This release is intended to be as broad and inclusive as permitted by California law.

This agreement does not release claims that cannot lawfully be released, including claims based upon gross negligence, reckless or intentional misconduct, to the extent such claims cannot legally be waived.

4. EVENT COURSE AND CONDITIONS

I understand that the Event may take place on public streets, sidewalks, trails, parking areas, private property, public property, or other locations that may remain open or accessible to vehicles, pedestrians, bicycles, animals, or members of the public.

I understand that the Event organizer cannot guarantee that the course will be free from hazards or that traffic, weather, surface conditions, or the conduct of other persons will be controlled at all times.

I agree to follow Event rules, posted signs, course markings, traffic controls, and reasonable instructions provided by Event officials, law enforcement personnel, volunteers, and other authorized personnel.

5. MEDICAL CONDITION AND RESPONSIBILITY

I certify that I am physically capable of participating in the Event.

I understand that it is my responsibility to consult with a physician or other qualified healthcare professional if I have questions or concerns regarding my ability to participate.

I agree not to participate if I know or reasonably believe that my physical or medical condition makes participation unsafe.

I understand that Event personnel are not responsible for determining whether I am medically or physically capable of participating.

6. EMERGENCY MEDICAL TREATMENT

If I become injured, ill, or otherwise require medical assistance during the Event and I am unable to provide consent at the time, I authorize Event personnel to obtain or provide reasonable emergency medical assistance on my behalf.

I understand that medical personnel, ambulance services, hospitals, physicians, or other providers may charge for services provided to me and that I am responsible for those charges to the extent not covered by insurance.

I understand that this authorization does not create an obligation for the Event organizer or Released Parties to provide medical care or guarantee the availability of any particular medical service.

7. PERSONAL PROPERTY

I understand that I am responsible for my personal property before, during, and after the Event.

I release the Released Parties from claims relating to the loss, theft, or damage of my personal property to the fullest extent permitted by law.

8. INDEMNIFICATION

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims brought by third parties arising from my own negligent or wrongful acts while participating in the Event.

Nothing in this provision requires me to indemnify a Released Party for that party's gross negligence, reckless conduct, intentional misconduct, or other liability that cannot lawfully be shifted to me.

9. COMPLIANCE WITH EVENT RULES

I agree to comply with the rules and safety requirements established for the Event.

I understand that Event officials may delay, modify, cancel, remove me from, or refuse my continued participation in the Event when reasonably necessary for safety, rule enforcement, course conditions, weather conditions, emergencies, or other circumstances affecting the Event.

10. PHOTOGRAPHY, VIDEO AND MEDIA RELEASE

I understand that photographs, video recordings, audio recordings, and other images or recordings may be made of me in connection with the Event.

As a condition of my participation in the Event, I grant the Event organizer and its authorized representatives, sponsors, and partners permission to photograph, film, record, and otherwise capture my name, image, likeness, and voice while I am participating in or attending the Event.

I authorize the Event organizer to use, reproduce, publish, display, distribute, and otherwise use such photographs, video, audio, or other recordings for lawful purposes related to the Event or the organization, including promotional, informational, historical, advertising, website, social media, print, and other organizational purposes, without compensation to me.

I understand that photographs and recordings may include individual images as well as group, crowd, course, start/finish line, awards, and other Event photographs, and that the Event organizer is not required to obtain additional approval from me before using such images or recordings.

I understand and agree that this media authorization is a condition of participation in the Event.

11. ELECTRONIC SIGNATURE AND RECORDS

I agree that this agreement may be presented, accepted, and signed electronically.

I intend my electronic signature, electronic acceptance, or other electronic indication of agreement to have the same legal effect as my handwritten signature.

I consent to the electronic creation and retention of records relating to this agreement and my participation in the Event.

12. SEVERABILITY

If any portion of this agreement is found to be invalid or unenforceable, I intend for the remaining portions to remain in effect to the fullest extent permitted by law.

13. GOVERNING LAW

This agreement shall be governed by and interpreted in accordance with the laws of the State of California.

14. ACKNOWLEDGMENT

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS ADULT PARTICIPANT WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK.

I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST THE RELEASED PARTIES FOR THEIR ORDINARY NEGLIGENCE.

I understand the terms of this agreement and voluntarily agree to be bound by them.
