LAPRAAC's Winter Games

ASSUMPTION OF RISK, WAIVER AND RELEASE

IN CONSIDERATION of being allowed to participate in the three day 2023 “LAPRAAC’S 3rd Annual Winter Invitational” event and all related activities and events (hereinafter “Winter Invitational”) to be held Monday February 27, 2023 through Wednesday, March 01, 2023 at Mammoth Mountain, California by the LOS ANGELES POLICE REVOLVER & ATHLETIC CLUB, INC. ("LAPRAAC"), the undersigned participant hereby personally assumes all risks in connection with his/her participation in and presence at the Winter Invitational and all of the related winter activities including any and all of the skiing, snowboarding, Nordic or other races and related events, from any and all harm, injury, damage and or death that may befall the undersigned in any way while I am a participant in and/or a spectator at the Winter Invitational including any and all risks of injury in connection therewith whether foreseen or unforeseen. The undersigned understands and agrees that neither LAPRAAC, nor the City of Los Angeles, and their officers, directors, employees, agents, representatives, attorneys, affiliates, sponsors, subsidiaries, related companies, successors and assigns (collectively “RELEASED PARTIES”) may be held liable or responsible in any way for any harm, injury, death, or other damages to me and or my family, heirs or assigns that may occur as a result of my participation in the Winter Invitational and all related winter activities and or events as a result of the negligence of any party, including the RELEASED PARTIES, whether passive or active in connection with the Winter Invitational, including any and all related events and activities.

The undersigned is aware and acknowledges that the Winter Invitational involves skiing and or snowboarding activity and all such activities and events are inherently dangerous and hazardous activities which can result in serious injuries and or death to either a participant or a spectator. However, the undersigned, being aware of the risks involved in such skiing and or snowboarding activities including his or her participation in the Winter Invitational wishes to participate in the Winter Invitational and to personally assume any and all of the risks as set forth above.

The undersigned, on behalf of myself, any and all of my family members, minor children and or guests, observers and spectators, and or any legal representatives, including my heirs, successors, assigns, executor(s) and administrator(s), and each of them, having voluntarily entered in the Winter Invitational either as a participant or as a spectator of the Winter Invitational, do hereby fully and completely to the maximum extent allowed by law waive, release and forever discharge the RELEASED PARTIES and each of them from any and all claims, charges, actions, suits, demands, obligations, damages, injuries, liabilities, losses and causes of action of every character, nature, kind or description arising out of or relating to my participation in the Winter Invitational and any and all skiing or snowboarding activities and events held at the Winter Invitational at Mammoth Mountain.

This is intended as a full and complete release of all liability of any nature whatsoever for all damage, injury, loss, expense, including any consequential expense, loss or damage, whether the same are now known or unknown to the undersigned, expected, or unexpected by the undersigned, or have appeared or developed, and all rights under Section 1542 of the California Civil Code are hereby expressly waived and relinquished. Section 1542 of the California Civil Code provides as follows:

“A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”

IN ADDITION, FOR VALUABLE CONSIDERATION, the receipt and adequacy of which are hereby acknowledged, the undersigned hereby agrees to indemnify and hold the RELEASED PARTIES harmless from any and all liability claims, demands, expenses of any nature, including attorney’s fees, expert fees and costs, incurred in connection with the released activities, including without limitation, injuries caused to a third party by the undersigned.

This release and the indemnity contained herein shall be binding upon the undersigned and inure to the benefit of the RELEASED PARTIES, and the officers, principals, legal representatives, assigns, members and successors in interest of each of them. If any provision hereof is found by a court of competent jurisdiction to be unenforceable or invalid the remaining provisions shall be unaffected and remain enforceable to the full extent of the law.

I hereby authorize LAPRAAC to contact me regarding future events and products.

THE UNDERSIGNED HAS FULLY READ THE ABOVE AND IS INFORMED OF THE CONTENTS OF THIS ASSUMPTION OF RISK, WAIVER AND RELEASE AND HAS WILLINGLY SIGNED IT ON BEHALF OF MYSELF AND MY HEIRS.
